(IANAL, but the "he" pronoun is almost certainly the old-fashioned grammar rule of defaulting to male when the gender is unknown.)

Noteworthy - that 1907 law was virtually never enforced. One wonders what motivated the "justice" system to target the 13 people who were charged (with only 5 convicted).
